Terms and Conditions for Wash Nerds Services

Welcome to Wash Nerds! These Terms and Conditions ("Terms") govern the agreement between Wash Nerds ("we," "us," or "our") and you, the client ("you" or "Buyer"), for the purchase and use of our website building, hosting, and SEO services ("Services"). By purchasing or using our Services, you agree to be bound by these Terms. Please read them carefully.

1. Services Provided

Wash Nerds offers the following Services, as detailed on our website (washnerd.com):

  • Base Website Package: Custom 8-page website, hosting, professional email address at your chosen domain, full design, and contact form for $80/month for the first 12 months, then $40/month, with a minimum 12-month commitment, followed by month-to-month billing.
  • Deluxe Website Package: Custom 12-page website, hosting, professional email address, blog with 3 SEO-optimized posts at launch, and contact form for $120/month for the first 12 months, then $40/month, with a minimum 12-month commitment, followed by month-to-month billing.
  • On-Page SEO Package: Blog addition and monthly SEO-optimized content updates for $100/month, cancel anytime.
  • Total SEO Package: On-Page SEO plus off-page SEO (backlinks to increase domain authority) for $400/month, cancel anytime.

All Services are subject to availability and may be modified or discontinued at our discretion, with notice provided as per Section 9.

2. Payment Terms

Billing: Payments are billed monthly via the payment method provided at checkout (e.g., Stripe, integrated through WooCommerce). You authorize us to charge your payment method for the applicable fees.

Website Packages (Base and Deluxe):

  • Initial 12-month term: $80/month (Base) or $120/month (Deluxe).
  • After 12 months: $40/month for both packages, billed month-to-month.
  • A minimum 12-month commitment applies (see Section 4 for cancellation details).

SEO Packages (On-Page and Total):

  • Billed monthly at $100 (On-Page) or $400 (Total), with no minimum commitment.

Taxes: You are responsible for any applicable taxes on the Services.

Late Payments: Failure to make timely payments may result in suspension of Services. We reserve the right to charge a late fee of 1.5% per month on overdue balances or the maximum permitted by Indiana law.

3. Domain Name Responsibility

Client Responsibility: You are responsible for purchasing and maintaining your domain name for use with the Services. The cost of the domain is not included in the Service fees.

Domain Purchase by Wash Nerds: If you have not already purchased a domain, we can purchase one on your behalf at cost through our preferred registrar, Hostinger.com. You will be invoiced for the exact cost of the domain, and you will own the domain upon purchase.

Domain Management: You must provide access to your domain registrar for setup (e.g., DNS settings). If we purchase the domain, we will provide you with login credentials to manage it.

4. Cancellation Policy and WordPress Access

Cancellation Anytime: You may cancel any Service at any time by contacting us at support@washnerd.com or through your account dashboard.

Website Packages (Base and Deluxe):

  • If you cancel within the first 12 months, you are responsible for paying the remaining balance to reach the total cost of the 12-month commitment (e.g., $80/month x remaining months for Base = $960 total; $120/month x remaining months for Deluxe = $1440 total). For example, if you cancel after 6 months of the Base Website Package, you must pay $80 x 6 = $480 to fulfill the 12-month commitment.
  • If you cancel after the initial 12-month term, no additional fees apply, and billing stops at the end of the current billing cycle.
  • WordPress Access: Upon cancellation, you will receive full access to your WordPress site (including admin credentials and files) if you are past the 12-month commitment or have paid the remaining balance to reach the 12-month total. Access will be provided within 7 business days of cancellation and payment confirmation.

SEO Packages (On-Page and Total):

  • No minimum commitment. Cancellation takes effect at the end of the current billing cycle, with no additional fees.

Refunds: No refunds are provided for partial months or services already rendered, except as required by Indiana law.

5. No Zip Code Exclusivity

Wash Nerds does not guarantee zip code or geographic exclusivity for any Services. We may provide similar Services to other clients in your area, and your website or SEO performance depends on various factors, including market competition and Google algorithms, which are beyond our control.

6. Ownership and Intellectual Property

Website Ownership: Upon full payment of the 12-month commitment for Website Packages, you own the custom website design (excluding third-party assets, plugins, or themes licensed separately). You will receive full WordPress site access as per Section 4.

Content: You are responsible for providing any content (text, images, logos) for your website. You grant Wash Nerds a non-exclusive license to use this content for the purpose of providing the Services.

Wash Nerds IP: All proprietary tools, templates, and processes used by Wash Nerds remain our intellectual property.

7. Service Delivery

Website Packages: Design and build typically take 2-4 weeks from receipt of your content and domain details. Hosting and email setup occur upon completion.

SEO Packages: On-Page SEO begins with blog integration and monthly updates. Total SEO includes off-page backlinks, with results varying based on market conditions (no guaranteed rankings).

Delays: You must provide necessary information (e.g., content, domain access) promptly. Delays in providing materials may extend delivery timelines.

8. Client Responsibilities

Provide accurate business information, content, and access (e.g., domain registrar credentials) for Service delivery.

Pay for and maintain your domain name as per Section 3.

Maintain compliance with all applicable laws, including data privacy and advertising regulations.

Ensure your website content does not violate third-party rights (e.g., copyrights, trademarks).

9. Modifications to Services

We reserve the right to modify, suspend, or discontinue any Service with 30 days’ written notice (via email or website announcement). If a Service is discontinued, you may cancel without penalty, and any prepaid fees for unrendered services will be refunded.

10. Limitation of Liability

Wash Nerds is not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities, arising from the Services. Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months. We do not guarantee specific SEO results, website traffic, or rankings due to factors beyond our control (e.g., search engine algorithms).

11. Disclaimer of Warranties

Services are provided “as is” without warranties of any kind, express or implied, except as required by Indiana law. We do not guarantee uninterrupted hosting, error-free websites, or specific SEO outcomes.

12. Termination

By You: As per Section 4 (Cancellation Policy).

By Us: We may terminate Services for non-payment, violation of these Terms, or illegal activity, with 14 days’ notice where feasible. Upon termination, you remain liable for any outstanding fees (e.g., remaining 12-month commitment for Website Packages).

13. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Marion County, Indiana.

15. Entire Agreement
